Recovery of losses from failed CDO Investment

Recovery of losses from failed CDO Investment

TO ALL MEMBERS OF THE COMMISSION

In 2010 the Commission was informed of a loss of A$1m in investments from a collateralized debt obligation (CDO) failure. The Commission also accepted a SCAF recommendation to write down a further investment of A$600 000 to A$152 468.

SCAF was advised at the time that an Australian law firm, Piper Alderman, was proposing to run a class action against the bank selling the CDO investments and that the Commission was invited to join that class action. The Commission also accepted the SCAF recommendation that it not join any litigation at that time.
